DMCA Policy for CBSE Guide
This Digital Millennium Copyright Act (DMCA) Policy (“Policy”) applies to the CBSE Guide website (“Website” or “Service”) and any related services (collectively, “Services”). It explains how CBSE Guide (“Operator,” “we,” “us,” or “our”) addresses copyright infringement notifications and how you (“you” or “your”) may submit a copyright complaint.
At CBSE Guide, we respect intellectual property rights and strictly comply with the provisions of the United States Digital Millennium Copyright Act (DMCA) of 1998. This Policy ensures that any copyright infringement claims are handled quickly, fairly, and in accordance with applicable law.
What to Consider Before Submitting a Copyright Complaint
Before filing a complaint, please check whether the use of the material may qualify as fair use. Under fair use, copyrighted content may be used without permission for purposes such as criticism, commentary, news reporting, teaching, research, or scholarship.
If you are unsure whether the content infringes your copyright, it is strongly recommended to consult with an attorney before proceeding.
Notifications of Infringement
If you are a copyright holder or an authorized agent and believe that material available on CBSE Guide infringes your rights, you may submit a copyright infringement notification (“Notification”).
Your Notification must include the following, as required under the DMCA:
- Identification of the copyrighted work claimed to be infringed.
- Identification of the infringing material, including its exact location on the Website (e.g., URL).
- Your contact information: name, address, phone number, and email address.
- A statement affirming that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement confirming that the information in your Notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
- Your physical or electronic signature.
Please send your Notification to our designated DMCA Agent at the details provided below.
Counter-Notifications
If you believe that your material was mistakenly removed or access was wrongly restricted, you may submit a counter-notification under sections 512(g)(2) and (3) of the DMCA.
Your counter-notification must include:
- Identification of the material that was removed or disabled, and its prior location.
- A statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled due to mistake or misidentification.
- Your full contact details: name, address, phone number, and email address.
- A statement that you consent to the jurisdiction of the federal district court where your address is located (or where CBSE Guide may be found if outside the U.S.), and that you accept service of process from the person who filed the original Notification.
- Your physical or electronic signature.
Upon receiving a valid counter-notification, we may forward it to the original complainant. If they do not file a court action within a reasonable time, the removed material may be restored.
Changes to This Policy
We reserve the right to modify or update this Policy at any time. When changes are made, the “Last Updated” date will be revised accordingly. Your continued use of our Website and Services indicates acceptance of the updated Policy.
